to Expediency-Oriented Principles</ArticleTitle>

		<Abstract>Clarifying the relationship between Islamic jurisprudence (fiqh) and illegitimate political power has long generated numerous theoretical and practical challenges within Shi‘i political thought. The principal issue addressed in this study is the examination of the principles and criteria governing interaction with unjust rulers (&lt;em&gt;hukkam al-jawr&lt;/em&gt;) and the extraction of a coherent model for regulating political conduct in the face of illegitimate authority. The necessity of this inquiry stems from the fact that Imamiya political jurisprudence, while rejecting the fundamental legitimacy of unjust rulers, has nevertheless developed—on the basis of public interests and social necessities—a multilayered framework that allows for either engagement with or abstention from cooperation with such governments. Employing a descriptive-analytical methodology and drawing upon authoritative juridical sources as well as the practical conduct (&lt;em&gt;Sira&lt;/em&gt;) of the Infallible Imams (A.S.), this research seeks to answer the following question: What are the limits and conditions governing interaction with unjust governments according to primary and secondary juridical rulings? The findings indicate that the model of interaction in Imamī jurisprudence rests upon two fundamental pillars: First, normative (obligatory) foundations, manifested in the prohibition of strengthening unjust rulers and cooperating in unlawful activities. Second, expediency-oriented principles, which, under secondary legal considerations such as preserving public order, assisting the oppressed, enjoining good, and safeguarding the higher interests of the Muslim community, permit—and in some circumstances even require—cooperation in lawful and beneficial matters. The study concludes that Shi‘i political jurisprudence, by distinguishing between the legitimacy of a ruler and the practical necessity of administering social affairs, presents a realistic and pragmatic model. Within this framework, interaction with an unjust ruler does not signify acceptance of illegitimate domination; rather, it functions as a means of achieving the higher objectives of religion and safeguarding the welfare and integrity of the Muslim community, as reflected in both the theoretical and practical conducts of Shi‘i jurists.&lt;br /&gt; </Abstract>
			<OtherAbstract Language="FA">تبیین نسبت میان «فقه» و «قدرت غیرمشروع»، از دیرباز چالش‌های نظری و عملی متعددی را در اندیشه سیاسی شیعه پدید آورده است. مسئله اصلی پژوهش حاضر، واکاوی ضوابط و معیارهای حاکم بر تعامل با حاکمان جور و استخراج الگویی منسجم برای تنظیم رفتار سیاسی در رویارویی با قدرت‌های غیرمشروع است. این ضرورت از آنجا ناشی می‌شود که فقه‌سیاسی امامیه، افزون بر نفی اصل مشروعیتِ جائر، براساس مصالح عامه و ضرورت‌های اجتماعی، چارچوبی چندلایه برای تعامل یا استنکاف ارائه داده است. این پژوهش با روش توصیفی‌ـ‌تحلیلی و با تکیه بر منابع اصیل فقهی و سیره عملی معصومان^، در پی پاسخ به این پرسش است که حدود و ثغور تعامل با حکومت‌های جائر براساس احکام اولیه و ثانویه چیست؟ یافته‌های تحقیق نشان می‌دهد که الگوی تعامل در فقه امامیه بر دو رکن استوار است: نخست، «مبانی تکلیفی» که در قالب حرمتِ تقویتِ جائر و همکاری در امور حرام تجلی می‌یابد؛ دوم، «ضوابط مصلحت‌محور» که تحت عناوین ثانویه‌ای همچون حفظ نظم عمومی، یاری مظلومان، اقامه امر به معروف و مصالح عالیه جامعه اسلامی، همکاری در امور مباح و خیرخواهانه را مجاز یا در مواردی واجب می‌شمارد. نتایج پژوهش گویای آن است که فقه‌سیاسی شیعه با تفکیک میان «مشروعیت حاکم» و «ضرورت تدبیر امور»، الگویی واقع‌گرایانه ارائه می‌دهد که در آن، تعامل با جائر نه به معنای پذیرش &lt;br /&gt;سلطه، بلکه ابزاری برای تحقق اهداف متعالی دین و صیانت از کیان جامعه اسلامی در سیره عملی و &lt;br /&gt;نظری فقهاست.&lt;br /&gt; </OtherAbstract>
