The main and central characteristic of jurisprudence in the works of the prominent and insightful jurist, the architect of the Islamic Republic of Iran, Grand Ayatollah Imam Ruhollah Mousavi Khomeini, is its governmental nature, referred to as governmental jurisprudence (Fiqh). The necessity of dealing with governmental jurisprudence in Imam Khomeini’s works lies in the fact that his jurisprudence serves as the foundation of the Islamic character of the Islamic Republic of Iran, and any inquiry into his valuable jurisprudence results in clarifying the foundations of this system. The findings of this study, first, examine the meaning and essence of governmental jurisprudence and its correspondence with jurisprudence in his works. Second, in analyzing the foundations of governmental jurisprudence, four principles are identified: the interconnection of religion and politics, the central role of government in individual and collective human prosperity, the government-centeredness of jurisprudential objectives, and the government-centeredness of jurisprudential rulings—all reflected in his writings. Third, within both his general jurisprudential works and his specific fatwas, three issues are analyzed and concluded. In the domain of general works, khitabat qanuniyya (general legal addresses), the governmental dimension of the la darar rule, and the primacy of governmental rulings in his perspective stand out as major aspects of the governmental nature of his jurisprudence.
