The development and flourishing of human potential constitute a prerequisite for achieving the higher objectives of an Islamic government. Since the realization of this goal is impossible without systematic institutional foundations, governmental jurisprudence (fiqh al-hukūmah) imposes specific obligations regarding the establishment of structures designed to cultivate and develop individual talents and capabilities. The present study employs a descriptive-analytical methodology to address the following question: Which jurisprudential principles provide the basis for obligating an Islamic government to establish structures aimed at fostering human potential and talent development? The findings indicate that several major jurisprudential principles support such an obligation. First, the principle of preserving the social order considers the continuity of political and social life dependent upon the cultivation of qualified human resources. One of the most significant factors in developing competent individuals is the identification and nurturing of their latent talents and abilities. Second, the principle of justice, through its rejection of discrimination, regards the provision of opportunities for personal growth and development as an application of the maxim “giving every rightful claimant his due” (iʿṭāʾ kull dhī ḥaqqin ḥaqqah). Third, the principles of no harm (lā ḍarar) and causation (tasbīb), from the perspective of safeguarding valuable resources, hold the government accountable for the waste of human potential and for negligence in creating the necessary institutional and structural foundations for talent development. Ultimately, these principles, together with the principle of rational correlation (mulāzamah ʿaqliyyah), establish the creation of appropriate structures for nurturing human potential as a religious and legal obligation incumbent upon an Islamic government.
