Every political system originates from specific foundations that are rooted in the intellectual framework, social contexts, and ideology of its founders as well as the people who have either contributed to its formation or accepted its authority. The more efficient and capacity-rich these foundations are for ensuring the effectiveness of the political system, the more sustainable and effective the system will be. This raises the question: Does Islamic fiqh (Islamic jurisprudence), as a foundational element of the Islamic political system, have the capacity to enhance the system’s efficiency? It must be stated that: first, fiqh itself must be efficient; and second, it must possess inherent capacities that can promote the efficiency of the political system—capacities that lead to problem-solving, breaking deadlocks, and opening new horizons for the system. In brief, Islamic political fiqh, with its structural and textual principles, as well as flexible and context-sensitive mechanisms, is not only efficient in itself but also has the capacity to enhance the effectiveness of the political system. This article examines the capacities of political fiqh for addressing challenges, breaking impasses, and expanding horizons for the efficiency of the political system, with attention to the elements of efficiency including ideas, structure, behavior, and agents.
